"Custody" is comprised of "legal" custody, or decision making power, and "residential" custody, or with whom the child resides. There are numerous custody arrangements which the parents may agree to, or which may be ordered by the Court. Parties may share legal custody, whereby each parent is entitled to share in the decision making for the children, may have "spheres of influence" whereby each parent is entitled to final decision making with relation to certain category of decisions (ie. religion, education, or extra-curriculars), or one parent may have sole legal custody. Your family's personal circumstances will determine which custody arrangement will be in the best interest of your child or children.
Residential Custody refers to which parent the child or children reside with. Like legal custody, parties may agree to various residential custody arrangements. One parent may have sole residential custody, while the other has visitation; parents may also have a "shared" parenting time arrangement, whereby parents share equal time with the child or children. It should be noted that such shared custody arrangements impact child support, thus parents should always consult with an experienced and knowledgable attorney prior to agreeing to a custody arrangement.
